The article is devoted to the disclosure of features criminal liability for intentional destructionor damage property provided in Art. 194 Criminal Code Ukraine. elements this composition offense, which are necessary qualification according specified law on liability, have been analyzed. author reveals problematic issues qualifying destruction or property, namely, commission crime by arson, explosion, other generally dangerous means, caused a particularly large scale, death serious consequences. emphasizes peculiarities difference between and related crimes, particular, violence against population area hostilities, violation laws customs war under martial law. This made it possible conclude that people’s committed arson explosion as result an act aggression Russian Federation Ukraine qualified Article 438 Ukraine, unlawful serviceman pretext military necessity hostilities should be 433 expresses author’s position regarding imperfect legal technique formulating provisions terms determining property.
